What you can do with your Artwork, what you cannot, and what it takes to unlock commercial rights.
1. Personal Use Rights
A Holder may use and display the Artwork associated with the specific OozGang Digital Collectible they own for personal, non-commercial purposes.
Permitted personal uses include social media, personal digital displays, personal prints, home décor, virtual spaces, and non-commercial community content.
Personal use may include reasonable filters, cropping, or presentation changes provided the use remains respectful of the Artwork and OozGang.
Personal use rights do not include ownership of the OozGang name, logo, trademarks, collection branding, individual traits, or Artwork associated with Digital Collectibles not owned by the Holder.
2. Commercial IP Rights and the Reversoz Requirement
Commercial IP rights for an OozGang Digital Collectible are available only to an Eligible Holder.
To qualify, the Holder must simultaneously own:
- One (1) OozGang Digital Collectible; and
- One (1) Reversoz Digital Collectible for each OozGang Digital Collectible being used commercially.
Commercial IP licensing operates on a one-to-one ownership basis.
A single Reversoz Digital Collectible may not simultaneously satisfy the commercial licensing requirement for multiple OozGang Digital Collectibles.
The Holder must maintain the required ownership ratio for the entire duration of the Commercial Use.
If a Holder transfers, sells, lists for sale, or otherwise ceases to own the required OozGang or corresponding Reversoz Digital Collectible, the applicable commercial license is immediately suspended or terminated.
OozGang may require the Holder to identify the OozGang and Reversoz Digital Collectibles being used to satisfy the licensing requirement.
Commercial IP rights are conditional licenses and are not permanent assignments of intellectual property ownership.
3. Permitted Commercial Use
Subject to these Terms, an Eligible Holder receives exclusive, royalty-free rights to use, reproduce, display, commercialize, sublicense, and create permitted derivative uses from the specific OozGang Artwork associated with the Digital Collectible they own.
These rights exist only while the Holder remains an Eligible Holder.
Commercial rights do not include rights to use the OozGang name, logo, trademarks, official branding, standalone traits, Artwork belonging to another Digital Collectible, or other official collection assets.
Text or logos may be placed next to or over Artwork only when the Artwork remains at least eighty percent (80%) visible and is not materially obscured, distorted, or altered.
Sublicensing is permitted solely in connection with an authorized use of the Holder's specific Artwork. The Holder remains responsible for sublicensee compliance.
OozGang takes no share of Holder revenue or profits from permitted Commercial Uses unless separately agreed in writing.
4. Use Restrictions
For Commercial Use, the Artwork must remain intact and may not be materially edited, distorted, recolored, reconstructed, or altered.
Individual traits may not be extracted, separated, reproduced, or commercially used as standalone assets.
The OozGang name, logo, trademarks, or official branding may not be used without written authorization.
The Artwork may not be used in connection with hateful, discriminatory, racist, explicit sexual, political, defamatory, fraudulent, deceptive, misleading, or illegal content or activity.
The Artwork may not be used in a manner reasonably determined to materially damage the OozGang or Reversoz brand, reputation, community, or intellectual property.
Adult themes, sexual wellness, or other sensitive commercial categories require prior written approval.
5. Reserved Categories
The following commercial categories are reserved for OozGang:
- Comics
- Trading cards
- Fashion
- Television shows
- Movies
- Animated productions
- Animation series or franchises
Personal or non-commercial fan use within reserved categories may be permitted if otherwise compliant with these Terms.
Clothing is permitted only as a secondary product supporting a broader independent brand, business, product, podcast, beverage, community, or similar operation.
OozGang Artwork may not form the core identity or primary commercial basis of a standalone clothing or fashion business without written approval.
6. Verification
OozGang may request reasonable information necessary to verify compliance with commercial licensing requirements, including verification of OozGang ownership, Reversoz ownership, the Artwork being commercially used, the nature of the Commercial Use, and sublicensee compliance.
Failure to reasonably demonstrate eligibility may result in suspension of commercial licensing rights.
